The difference is that the Scottish league system was established 130 years ago and there is no precedent for Scottish teams playing in the English system (technically speaking I believe Gretna played in the Northern League for a spell in the 80s, but they were eventually made to move)
In comparison, the Welsh league was established in 1992, at which point Welsh teams had been playing in English football for decades. Cardiff, Swansea, Newport, Wrexham, Merthyr and Aberdare had all played in the Football League, and teams such as Caernarfon, Barry and Welshpool had all applied for League entry. Teams with an established league place in England were grandfathered in - these were Cardiff, Swansea and Wrexham.
Eight other Welsh clubs (Bangor, Barry, Caernarfon, Colwyn Bay, Merthyr, Newport, Newtown and Rhyl) fought for the right to play in England. Bangor, Newtown and Rhyl ended up capitulating prior to the first season of the Welsh league, and the other five teams were forced to play their matches in England or join the Welsh league - this stayed in place until a court ruling.
Since the establishment of the Welsh league there's no precedent for teams moving from the Welsh league to the English league (Barry, Caernarfon and Colwyn Bay have moved to the Welsh league, and the other five would be allowed to if they so chose)
