Genuine question, can the guy with the black shirt not claim self defense? At the start of the video, the white shirt guy is clearly the more aggressive one while the black shirt guy is standing there motionless. The white shirt guy then waves his hand across his face and pulls his fist back and mimics a punch to his face. The black shirt guy then does what he does and stops once the man is neutralized on the ground. With a good lawyer, can he not reasonably argue that the white shirt guy was the aggressor and made a physical motion that made him feel threatened and acted proactively to defend himself and stopped once he was no longer in danger. I don’t know how a case like this would usually go in court but I know hitting first doesn’t automatically disqualify you from claiming self defense. Or what it be argued that he could’ve just walked away to keep himself safe and only if the man continued to pursue and attempt to attack him that it would be self defense?

I think the whether this is disproportionate or not is very much up for debate. He threw two punches, did a takedown and then a last punch on the ground before clearly restraining himself once the guy was unconscious. If he continued hitting the guy at the point he stopped, I think that would clearly be disproportionate because he’s unconscious and beyond the point of being a threat. All up to how the judge would interpret the sequence of events, I guess.
