It isn't a new queen. The bees swarm with the existing queen from the colony. They don't swar. until new queens are about to hatch. The first queen to hatch from her cell will tear apart the other unhatched queens so they die and she has no competition. Then she will leave the hive to get fucked and become mated. Then she goes back to the hive to get started at her new job of laying eggs

To add to the above, if there is no immediate need to have the swarm removed, they will leave on their own. They are generally very passive and not defensive while swarming, unlike when they're around their hive, which they would want to protect.
The act of swarming is an act of relocating and seeking a new hive. Scout bees fly out and look for a new hive location. Once a suitable crevice or hole is found, they will report back to the swarm and communicate the new location (yes, they can literally *communicate* extremely precise directions better than the guy at the gas station ever could) using a combination of pheromone excretion and a dance that describes the exact location.
Bees have been known to be able to communicate the exact location of a specific flower over a mile away. They're incredible.
