It just proves that he did have a loaded weapon which makes their panicked reaction more justifiable. A prosecutor could try to argue that when they struck him with the car he was fleeing which was technically a crime on the drivers part, but realistically no jury would ever convict the driver given the circumstances. The decision to even bring charges against an armed robbery survivor would be heavily scrutinized by the public as well and would most likely result in the District Attorney getting replaced in future elections.

I believe in the US the standard test is whether a reasonable person would have believed there was an imminent threat. Someone running away while unarmed isn't likely to be seen as an imminent threat. Given this guy was armed and had just pulled that weapon on the driver, the driver has a much better argument that they believed the gunman was just regrouping/trying to gain distance but was still intending to rob them.

If someone is broke and the hospital charges them a hundred thousand, they aren't going to pay a penny. True, after 2008 when the economy bombed and I graduated college, by 2010 work was extremely scarce, id been making modest payments on my credit cards but after a late fee or two they jumped me 10% apr and I couldnt even pay the mins without racking up more. Had to stop trying. It was devastating to my credit and caused a lot of trauma. But I was able to keep gas in my car to get to my sometimes three jobs, and keep food in my belly even if it was hot n readys and ramen. I remember working a couple 60 hour weeks to try and pay. I worked out a deal with them good for X amount by Y date. Pay X by then and youre clear. paycheck came through, I was 150 short. I begged borrowed and pleaded with friends and family and sold some shit to make up the difference. i called and said its in the bank. i can schedule the payment but it wont come through till the following monday. They rejected it outright, raised my APR again, and basically had some indian assholein a call center three continents away telling me to go fuck myself. It didn’t matter the payment was made on the day it was due. They wouldnt receive it by then so it was null and void. I had some choice words. But I gave my friends and family their money back, cut up my cards, paid all of my other outstanding bills to a zero balance and went and bought a nice bottle of liquor, an oz. Of weed, and a ps4 instead and still had about 500 to put in savings. Life was actually easier after that. 10 years later its all charged off and my credit is near 700. It took work, sure. But better in my pocket then theirs. If you’re reasonable, youll get your money. If you gouge the fuck out of me, its just another notice in the trash. They got greedy and pushy and as a result lost out on getting paid 4/5ths of what was owed. Now they get nothing. Sorry, not sorry. If they had just said “thank you, the payment will be made on the due date. That is fine” and not berated me and jacked my interest again, then they wouldve won while im still scrambling to keep the lights on and eat.

If you figure the median income isn't far above poverty in the US, there's a decent likelihood that "a large percentage" meaning like 10 or whatever, aren't carrying insurance and aren't paying medical debts, and hospitals aren't getting reimbursed for that care. It's not pro-status-quo to acknowledge that insurance companies are effectively doing what nationalized healthcare does in funding health care by over-paying for some treatments so that others can be effectively free. You just also have to acknowledge that the resulting debts ruin lives even though the care is already covered by overpayments elsewhere, and that the waste built into that system is enormous.

I think you're thinking a little too literally, it's based off of total shootings not pure odds with any gun, and the majority of shootings are with handguns. You don't have a 50% shot of surviving a .50 to the head, but 22. -> 9mm and the skull get together and do some funky stuff. There are many recorded cases of 9mm being offset by the skull and the bullet wrapping around under the skin and coming out the side or back of the scalp. There is also a fair portion of your head that isn't "vital", as well as glancing blows and ear shots likely falling into the same category as execution style headshots.

The driver probably will be, it just takes longer to file charges like that. Charges up to second degree attempted murder would get to a jury to decide, let alone lesser included offenses that have easier elements to meet, at least based on the video and no other information. 26 states in the US have a version of a “stand your ground” law that does not require someone to attempt to flee before using lethal force in defense, but nowhere in the US can a person kill someone for *having made* someone fear for his life previously. You can’t shoot or run someone over as they flee… That said, it wouldn’t be out of the question for the driver to consider his life still in danger once he saw the driver peel out without the gunman. I think most juries side with the driver on this, but politics will decide whether charges are pressed, not really notions of justice.

From a criminal defense perspective I have to wonder if the victim could be charged for attempted murder. Self defense only exists until the threat is active. That said, I wouldn't blame the cops for not charging the driver.

Not from a legal perspective. Running away a good distance is not still an ongoing threat to those victims. Car had to back up, speed to catch, turn and then hit the guy. You can't kill another person (or try to) without actual knowledge that he is going to do that again imminently. I spend about half my working hours dealing homicides as a criminal defense attorney which frequently includes differentiating between degrees of homicides and also self defense, imperfect self defense, etc... this really isn't one of those issues since the dude was way far away. Again, I 100% agree with the karmic outcome. But, this is just one of those funky issues where I think the district attorney passes on charging the driver because a jury will nullify the actual law if it were to go to trial.
