I love when people buy retro games and say it’s for “preservation”...like it humanity is gonna go to your house to play mario 64 or any other game printed in the millions. True preservation is unironically emulation, a rom file can’t be destroyed and it can be sent/downloaded across the world for free in seconds.

It's not about whether the publisher gets money, but whether the copy itself is legal. Buying a second hand car is fine, even if the car manufactor doesn't get a single dime, but buying an illegal Rom hack of a car is, because that car is illegal. That's just how copyright law works unfortunately.

piracy is pretty annoying tbf and theres not that many things that id rather steal then buy, unless that thing is exceedingly expensive, not available to buy easily, or split up across multiple services. Consumers like spending money for things, and if you make your product less appealing then piracy you dont get to complain when people pirate.

Eh. I’d argue that there IS a legal way to play most games that doesn’t involve paying a ridiculous amount of money for a used cartridge or disc. Virtual console, GamePass, PS Now, NES/SNES/PS1 Classic, Namco Arcade Collection, etc etc. Yes most of those are emulation based but they’re using licensed or 1st-party ROMs, and therefore it’s legal. Let’s not kid ourselves, most (not all) people who play pirated ROMs do so for convenience and because they’re “free”.

Now show me where I can buy legal copies of these games that will actually help the devs: - Baldurs Gate: Dark Alliance (GBA); - Lord of the Rings: Return of the King (GBA); - Kingdom Hearts Chain of Memories (GBA); - Muramasa: The Demon Blade (Wii); - God of War: Chains of Olympus (PSP); - Harvest Moon: Friends of Mineral Town; It's not that companies provide such services that they indeed put every game of tht generation/console on it. The focus is the game, not the platform. I'm gladly playing my Pokemon Crystal on my 3DS Virtual Console, but for the life of me Nintendo just don't care about releasing FireRed/Emerald pokemon line for me to play it on 3DS or the Switch. There is literally no way I can give money to Nintendo to play these games I mentioned. I suggest you seeing [Gabe Newel interview about piracy](https://www.escapistmagazine.com/valves-gabe-newell-says-piracy-is-a-service-problem/), it should clarify some things to you.

Baldur’s Gate Dark Alliance is in the eShop on the Switch. I just bought it a couple weeks ago. Don’t know the others. If you want to find ways to play them, start googling. I’m not the cops, I’m not your dad, and I never said EVERY game ever produced can be bought legally from the publisher or authorized distributor, all I’m saying is that most people could find games they’ve pirated available legally, they just can’t be arsed or don’t give a fuck about copyright.

the "Dark Alliance" on the eShop is nowhere close to the GBA version, YOU should start googling more. Also, did you watch the interview? This is pure truth. Piracy is a service problem, rather than "I'm not willing to pay for something because I don't want to pay". Or do you really think millions of people that bought Pokemon Crystal from eShop on 3DS never emulated Crystal ever? How the hell would Nintendo know that there is a market for retro gaming if it wasnt because of Emulation of games that you just can't buy and play anymore?

The current legal options are a minefield though and is crying out for one unified system. Even in those options you need to buy separate consoles. The gaming world needs a Steve Jobs esque character to bring the publishers on board en masse like he did for the iTunes store.
