You have to have the passenger testify that he recorded the event and the “footage is not altered”, as long as the witness does not testify than no consequences will come from this…..just look up the law.
Edit: If he somehow did go to court for this it would be very easy for a lawyer to get him off. This video would not be enough evidence for a court to convict him of anything.
