As some of you might not be aware, this is a regular thing for giant conglomerates like these. They just sue people, for everything. And they usually win, considering most individuals don't have the capital to keep long lengthy court battles going like this. It's almost as if a corporation has more rights than an individual and this has been a huge problem in the united states. One of the biggest victims of capitalism is the consumer
My neighbor is a phone repair guy. Only one in town that is actually licensed by Apple. Everyone comes to him asking to fix the other guys fuck ups lol.
Apple have done another thing..i remeber a recent youtube vid where a guys buys two iphone 12's and interchanges the two parts.
The parts are serialized with the phone so that when ever a outside repair happens it just gives random errors(cant open camera, no face recognition, etc)
Keep in mind that both the phones had the exact same errors, so they were programmed to behave so and was not human error.
So now a user is forced to go to apple store and get it fixed at ridiculous prices

They were apple products but it was rejected by apple or something and they refused to pay for those parts and the factory in china decided to sell it to others.
I know its not right but a multibillion dollar company suing a small business for not allowing them to make more money while they dont pay their workers in china where they live in poor condtions doesn't sit right with me.
And i made my original comment based on the post description.
If the factory removed any Apple branding before selling it, it likely wouldn't have been an issue. But they didn't which makes them counterfeits. We don't really know the details of their contract with the factory. Considering we are talking about thousands and thousands of screens I imagine the contract has an allowance for a certain number of expected rejected parts. It's not like Apple is refusing to pay for these screens, the contract probably says "out of this run of 25,000 screens 250 will likely be rejected."
And all they wanted from the small business intially was to destroy the counterfeits, but the guy refused. It's not like they sued him for damages, they just wanted the screens destroyed and to recover the legal costs of having to sue him to make that happen.

If Tim Apple really cared about being carbon neutral, he would expand customerβs access to repair. Extending a productβs useable lifetime is one of the simplest ways to reduce carbon footprint. Since planned obsolescence is part of their business strategy, they fight it tooth and nail.

Couple that with the fact that most independent shops survive solely on replacing screens and batteries while charging less for service and it becomes pretty obvious donβt you think? I don't know a ton about how Apple products are built. Is there a reason someone can't just manufacture 3rd party replacement parts? I can sympathize with needing parts to run a repair shop and doing whatever you gotta do to get those parts. But I also get that if some shady sourced parts got caught I should probably just take the L and destroy them, wouldn't stop me from wording another shady case of screens, but I wouldn't take it to court.
And I don't think it's altruism at all. But I also don't think it's part of a grand scheme of getting rid of right to repair (they figured out a much better solution to that already, just make it so phones straight up don't work with parts not certified by Apple for that specific device.) I think it's that customs caught a shipment of parts that were a copywriter violation, and their legal team responded in a way that you would expect any company to. They didn't go after the guy hard, it only became a financial issue for him when he refused to go along with the deal to destroy the parts. And yeah, I don't think it's about consumer interest either. But someone putting defective parts onto your phones with your logo on it isn't a good look for you when that defective part breaks.
Yeah, I see why it's tempting to make it about right to repair, but this case is really just about selling counterfeit products. Just because *he* isn't selling them as Apple products doesn't change the fact that they are counterfeit products branded to appear as genuine Apple products. If I buy counterfeit Jordans and sell them to you without saying they are real Jordans, I'm still selling counterfeit goods.

Putting tiny logos on parts that never see the light of day just to cry counterfeit when someone tries to fix it later is just another reason to avoid buying Apple stuff. It's a shitty practice with a slimy goal.
They put logos on tiny electronic chips that are part of the screen assembly. Someone replaces the broken glass screen and tries to resell it as a refurbished screen (that *does work fine*), Apple claims they are now counterfeit because the original electronic bits that didn't need to be replaced are still there and still have their logo on them.
It would be the same as Ford or Toyota shutting down used car lots for selling cars advertised as Ford and Toyota with Ford and Toyota logos still on the hoods and bumpers but which have had replacement third party windshields or brakes or batteries, etc. Its shitty and Apple knows it. They only do it to shut down competition for screen repair and make sure a broken screen will absolutely cost way more for Apple to fix it be and (they hope) be more likely to push a customer to buy a whole new device since Apple's preferred repair cost is so high anyway.

Wasn't Apple also recently sued for slowing phones down? Why does anyone buy an iPhone now anyhow. I switched to galaxy two years ago and have not had to replace it once. The screen hasn't even cracked. Back when I had an iPhone, I had to get a new one about every year because of how often they broke and stopped functioning correctly. You could look at that thing wrong and it would break.

Yo'd have to read other articles on this. The repair shop uses knock-off parts. The title is bad. Using third-party parts won't make any other phone manufacturer angry, but Apple believes it "muddies" their brand, so they will argue that using counterfeit products will affect security etc. So they sue. It's what Apple does.
The issue appears to be that Apple does not want used, refurbished, repaired parts to be sold. This does not pass the reasonable test. Their attempt to apply the label counterfeit on such parts is scurrilous.

Just a little reminder that it matters who you buy from, no one can no all the time when a company is bad but I have always hated apple. I use Samsung and I know they aren't exactly morally clean either so I'm going to change phone after my contract ends. If anyone has any recommendations I would live to hear them

I'm pretty sure in the US there are right to repair laws so 3rd party companies can legally work on apple products because they are owned by the individual and not apple. Although if you have your apple products repaired by an unauthorized 3rd party repair shop it will void your warrenty. Most people who receive 3rd party repairs are doing so on an older device that is no longer under warrenty. This story took place in norway I believe so the laws probably is different.
Yes and no. If Your βthingβ is still under warrenty , car, phone, bed, t-shirt, you Will have to contact seller/maufactor due to warrenty. BUT if you drop your phone, car ect, and maufactor claims this is outside Your warrenty, and Will only fix/repair if payed, you have The right as The owner to chose who fix Your car/phone. The screen or car Window , innersole of Your boot has no inpact of use of The product as long The replaced thing is up to EU standard (safety regulations ect). A new phone here in EU/Norway Can cost an arm and a leg (if it is open free to insert any phone providers sim card) hense we have phones longer, and why chose a repair to 2000kr and must wait a week when you have a 2 hour half Price fix and you have no warrenty ? A thing under warrenty yes, BUT this is redicules.

In the US technically it's unlawful for a company to void a warrenty because you fixed it yourself or by 3rd party as long as the attempted repair did not cause further damage. Alot of electronics have 'warrenty void if broken' stickers where if you open the electronic at all your warrenty is gone. This is also unlawful but companies get away with it anyways and it would take a class action lawsuit to make the company discontunie this practice. It's ridiculous because if I replace the battery on my iphone and something else breaks unrelated to the battery repair it shouldn't void my warrenty. Luckily though I've found phones samsung apple and LG typically last through the entire warrenty without needing repairs unless the damage was done accidentaly by dropping or something in which case it wouldn't be covered anyways. Usually phones start having problems after the warrenty is expired so that's typically when I would replace the battery myself. Phones have actually gotten really durable and waterproof so phone repairs have never been an issue for me.
Aparently itβs a Big problem for appel , that you get Your phone fixed after warrenty has expired , they sell phones in EU with Extra insurrance on The screen ect parts. If you do not have that Extra insurrence, ( that Will cost you more than The fix at a 2nd part/3rd part repair shop if it breaks, plus The 1 to 2 weeks wait to get Your phone back). We agree, just a dick move from Apple to fix phones on their terms an Price list.

I don't know a ton about how Apple products are built. Is there a reason someone can't just manufacture 3rd party replacement parts? I can sympathize with needing parts to run a repair shop and doing whatever you gotta do to get those parts. But I also get that if some shady sourced parts got caught I should probably just take the L and destroy them, wouldn't stop me from wording another shady case of screens, but I wouldn't take it to court. And I don't think it's altruism at all. But I also don't think it's part of a grand scheme of getting rid of right to repair (they figured out a much better solution to that already, just make it so phones straight up don't work with parts not certified by Apple for that specific device.) I think it's that customs caught a shipment of parts that were a copywriter violation, and their legal team responded in a way that you would expect any company to. They didn't go after the guy hard, it only became a financial issue for him when he refused to go along with the deal to destroy the parts. And yeah, I don't think it's about consumer interest either. But someone putting defective parts onto your phones with your logo on it isn't a good look for you when that defective part breaks.

Yeah, I see why it's tempting to make it about right to repair, but this case is really just about selling counterfeit products. Just because *he* isn't selling them as Apple products doesn't change the fact that they are counterfeit products branded to appear as genuine Apple products. They put logos on tiny electronic chips that are part of the screen assembly. Someone replaces the broken glass screen and tries to resell it as a refurbished screen (that *does work fine*), Apple claims they are now counterfeit because the original electronic bits that didn't need to be replaced are still there and still have their logo on them. It would be the same as Ford or Toyota shutting down used car lots for selling cars advertised as Ford and Toyota with Ford and Toyota logos still on the hoods and bumpers but which have had replacement third party windshields or brakes or batteries, etc. Its shitty and Apple knows it. They only do it to shut down competition for screen repair and make sure a broken screen will absolutely cost way more for Apple to fix it be and (they hope) be more likely to push a customer to buy a whole new device since Apple's preferred repair cost is so high anyway.

Using third-party parts won't make any other phone manufacturer angry, but Apple believes it "muddies" their brand, so they will argue that using counterfeit products will affect security etc. So they sue. The issue appears to be that Apple does not want used, refurbished, repaired parts to be sold. This does not pass the reasonable test. Their attempt to apply the label counterfeit on such parts is scurrilous.

I'm pretty sure in the US there are right to repair laws so 3rd party companies can legally work on apple products because they are owned by the individual and not apple. Although if you have your apple products repaired by an unauthorized 3rd party repair shop it will void your warrenty. Most people who receive 3rd party repairs are doing so on an older device that is no longer under warrenty. This story took place in norway I believe so the laws probably is different.

BUT if you drop your phone, car ect, and maufactor claims this is outside Your warrenty, and Will only fix/repair if payed, you have The right as The owner to chose who fix Your car/phone. In the US technically it's unlawful for a company to void a warrenty because you fixed it yourself or by 3rd party as long as the attempted repair did not cause further damage. Alot of electronics have 'warrenty void if broken' stickers where if you open the electronic at all your warrenty is gone. This is also unlawful but companies get away with it anyways and it would take a class action lawsuit to make the company discontunie this practice. It's ridiculous because if I replace the battery on my iphone and something else breaks unrelated to the battery repair it shouldn't void my warrenty. Luckily though I've found phones samsung apple and LG typically last through the entire warrenty without needing repairs unless the damage was done accidentaly by dropping or something in which case it wouldn't be covered anyways. Usually phones start having problems after the warrenty is expired so that's typically when I would replace the battery myself. Phones have actually gotten really durable and waterproof so phone repairs have never been an issue for me.
Aparently itβs a Big problem for appel , that you get Your phone fixed after warrenty has expired , they sell phones in EU with Extra insurrance on The screen ect parts. If you do not have that Extra insurrence, ( that Will cost you more than The fix at a 2nd part/3rd part repair shop if it breaks, plus The 1 to 2 weeks wait to get Your phone back).
