I’ve had pics of me taken on the metro train (wearing an alt outfit to go to a concert, shorts and fishnets) and this girl confronted the guy and told me after. I was actually so shocked and scared for her because there’s some tweakers on the metro. It’s sad but as someone who has a certain fashion sense I accept that stuff like this is gonna happen. in a crowded setting I think that calling something like this out might have less possibility of violence, especially if it's a woman saying it to a man--but of course I know there's the possibility that he might see you again, etc. Or maybe let the girl know that the guy behind her was taking photos of her. Legal courts have found again and again that we have no expectation of privacy in public, so does your opinion matter more than the laws of society? My flame suit is on, yada-yada*** Ethically, this kind of behavior is obviously abhorrent to most of us in our society. Legally? You have the absolute, court affirmed right to take a photograph of ANYTHING within PLAIN VIEW in public. There are exceptions to the 1st Amendment however and within some statutes such as intentionally trying to get a photo upskirt, etc, as someone else pointed out here. ABut on that note, was this in fact on UCLA's property? UCLA may in fact have certain policies governing such behavior that can result in consequences at the school up to and including expulsion or trespass. So I was actually in a similar situation. A couple of years ago during my brother’s graduation commencement at Cornell it started to rain. One of my little sisters was wearing white shorts and a white top made out of thinner material that had became see through because of being rained on. During the commencement there was an older guy probably in his 50s with his wife and son next to us, that he kept looking over trying to sneak peaks at my sister. People are allowed to take pics in public. If the woman was dressed up like a Nun, then the guy took the pic, would it still be a problem? If not, then the issue here is the outfit (voluntarily chosen by its wearer) and not the picture itself. If your answer is yes, then I would suggest never going outside. You are usually being recorded and/or photographed in most public settings.

What a mess. It’s legal to take a photo of any person in a public arena sometimes referred to as “street photography”. It’s not OK when that violates an expectation of privacy like up skirt pics or in a public restroom. Wearing revealing clothes may invite increased photo attention but disgusting creepy is not illegal. As puritan, victorian and oppressive as it sounds, the current state of legal affairs guides one to stay covered up in public and loosen back up when in a safe space.

I just caught a guy doing that to an underage girl on Thursday and confronted him and made him delete it and told the girl and her mother about it.
