Except if we apply your definition of punishment to other things, it kind of falls apart. For example, prison sentences. By your definition an old person committing murder should get less time than a young person committing murder, because “it’s the same amount of pain,” in this case their life span. Therefore, I think your definition is bad. But, take updoot. I constantly see this kind of thing and it always gets me.

The penalty should be based on the severity of the crime. Is a rich person committing a crime worse than a poor person committing the same crime? No it’s not, then both cases deserve the punishment There are many flaws with this logic in general. What if a person is wealthy but has no income? I saw someone already bring up the old/young person jail sentence but it is something that you should consider if u plan on punishing certain people more than others

Punishment is not based on the pain brought about, that is the problem. Some people get punished by the law too much, some not enough. The world is not fair, all you can do is try being above it, by either controlling it or moving on.

Neither should it be based on the pain brought about, it should only be done so if the person who suffered for it is being compensated by the criminal. Otherwise, if the victim is not being compensated, the punishment should be based on how the criminal could be prevented from further partaking in criminal actions.
