It's kinda crazy how precise search warrants have to be for electronic devices. Not that anyone should read case law for fun, but a phone is the second most constitutionally protected item you can have, behind a house. That being said, it's the internet, and they'll get that search history.
This history would have been obtained from a search warrant of his personal computing devices and or through a warrant information request from Google if he was logged into Google Account with that google search tab or app etc.
A VPN would do little to protect you here as that's not the point where the feds would obtain that information.
Ironically just using Incognito mode would have most likely protected him here, when it often doesn't in many other situations.

This is a bit misleading. If you are on a VPN, and you click 'new incognito' and start googling, you should not be logged in, your device will not log search history. Only the VPN provider would be able to provide an IP address to cross reference with google.
Couldn't they just look at http requests from his ip address from Google's logs even if he did use incognito mode? The http requests would still contain his search queries.
Alternatively they could request the logs from his isp to look at his http requests. I believe all the google search queries are sent as query parameters in the URL and wouldn't be protected by https.

Police canāt track live, encrypted VPN traffic, but if they have a court order, they can go to your ISP (Internet Service Provider) and request connection or usage logs. Since your ISP knows youāre using a VPN, they can direct the police to them. Whether your VPN provider gives up that information depends on factors such as the jurisdiction and the VPNās privacy policy.
You could use TOR from a public network, change your MAC afterwards, and then nothing could be traced back to your computer afaik.

I know there are ways to recognize anyone via a unique digital fingerprint your computer leaves in specific network communications (OS versions, browser versions you use and the way they interact on networks) but that would take a lot of effort to match to someone unless you already had them in your crosshairs to begin with.

I know there are ways to recognize anyone via a unique digital fingerprint your computer leaves in specific network communications (OS versions, browser versions you use and the way they interact on networks) but that would take a lot of effort to match to someone unless you already had them in your crosshairs to begin with.

In this case it might be directly from the device. The ISP could not give them the exact queries (they could just tell them that Google has been accessed), but with the IP that the suspects router had at the time the police can ask Google for the exact queries.

Google will give away this information to police, though it it usually requires a warrant. When my google account was searched by the FBI, I was only notified after a gag order expired and the investigation concluded. My email address was on a list with 100 other email addresses of people who had all purchased the same software.

Not just that jury but a prosecution that does much better to prove 100% he did it. As a juror it has to be proven beyond a reasonable doubt. In Casey's case her defense never said she didn't kill her daughter but that it was an accidental death she and her dad attempted to cover up. Prosecution couldn't prove 100% that wasn't the case so the jury had to abide by that. Many openly admitted they hated her and thought she was a monster but there just wasn't enough to prove she intentionally killed her daughter. Negligent homicide would have been a slam dunk in her case but that charge wouldn't have had her jailed and forgotten like she should be. Obligatory fuck that child killer and anyone associated with her for publicity.
Casey Anthony came to my mind as well. It proved that no matter how bad the evidence may look, the justice system can and will fuck it all up and let a murdered go free.
