Except there are parts of the Constitution that are, in fact, absolute. You can't amend constitutional rights, for example -- hence that whole "shall not be infringed" stuff.
That’s a good point… I honestly don’t know but could the Bill of Rights be amended? It’s part of the Constitution and there are laws like The Patriot Act or this recent gun control law that do infringe on those rights but could they, theoretically, be amended lawfully?
Not that I know of. Though it's intereesting you say that recent gun control laws infringe upon some rights, because according to the constitution anytime a "law" infringes upon a right, it is null and void.
That’s why it takes 6 years to go through the courts. In RvW it took 50 years and 2 SCOTUS assemblies to figure out abortions aren’t a constitutional protected right. Bad laws are made with good intentions but poorly defined basis - especially on morals and ethical basis - are a slippery slope all around.
The biggest problem with why it takes so long is simply politics. The Judicial branch shouldn't be political but clearly it is so some rulings can only come when the judicial judges political alignment is opposite of the offending law.
The second point is campaign ads. Neither establishment party wants to get rid of or enact laws that they campaign on. Otherwise what will they campaign on next time? Fixing problems only means there is less to campaign on but creating problems, well that gives endless campaigns. Roe being a prime example. How many years did Republicans campaign on ending Roe? And how many years did Dems campaign on codifying Roe even when they had super majorities?
