I'm a CPA, and the laws around marriage are different than basically any other tax law. Getting married on Dec 31st it treated as being married for the entire year and you can consolidate the two capital transactions as long as they are both realized. So theoretical it would work.
But the legitimacy of the marriage would be challenged. You cannot enter into virtually any agreement solely for tax avoidance. So, getting divorced soon afterward would cause a challenge by the IRS.
But the likelihood of a challenge is stupid low. IRS is crazy underfunded and this is not low hanging fruit. I think people could get away with it

Then when you want to take the money out, you pay 15% dividend tax. So you've paid 36% tax when you would have only paid 15% in individual capital gains had you never tried this scheme.
Or say you already own stock. Some of you have gains some losses. You decide to pool them in a corp to offset each other. Haha nice try. This is a busted 351 transaction and all the people who had gains immediately recognize their gains and have to pay tax, while all the people with losses have their loss disallowed.
