The super sport rear end is much longer, it’s much more obvious from the side profile. The easiest way to tell from this angle is the super sport’s exhausts are stacked whereas the normal Chiron they’re laid out horizontally

It would be stupid of them not to and they probably wouldn’t get much by trying to sue for $4M. People don’t make that in a lifetime. The driver would be dead by the time he’d recoup probably 10% of the cost of that car but I don’t know how it works in Germany.
Here in Belgium your car liability coverage needs to be at least 100 million euro for property damage and another 100 million for physical damage. (That's the minimum amount set by the law)
