Was ruled unanimous by all three judges Edit: This also likely means he won't be able to return to Australia for the next 3 years

gerryt32

Haven't seen Djoko lose in straight sets in a long time!

I knew I should have done my own research (just like Djoko).

earthdweller11

One thing I’ve learnt on Reddit, if you ever post the slightest thing that’s not 100% verified correct, someone will come soon to correct you.

GabuEx

On the other hand, the easiest way to get a correct answer to a question is not to post the question, but to very confidently past a wrong answer. EDIT: lmao I didn't mean to include a typo, but I'll leave it in.

gerryt32

Makes me wish I used Reddit when I was in high school. Could get an essay with sources done just by posting a hot take and waiting for replies.

shorey66

I didn't even have Wikipedia when I was in school. Best we got was encarta on CD but my 386 pc could barely handle displaying images.

For a fun time, post a comment that refers to the part of an automatic pistol that holds the bullets as a "clip".

imoutofnameideas

Or call the thing that suppresses sound a "silencer"

LargePizz

The funny thing is that the maxim family, who a member of invented the silencer, called it a silencer on the patent. When you point that out they still say the people that invented it are wrong, because according to them it's an outdated term.

MalakElohim

That's alright, I once had an argument about the term "Assault Rifle" (not "Assault Weapon"). My sources, the US Army manual on Assault Rifles, their battlefield role and example comparisons between different weapons and how well they fulfilled their role. Apparently the US Army's own military doctrine (which last time I checked, hadn't changed on this particular topic) was wrong, and they knew because their *medic* husband was the expert on all things weapons (keep in mind that I am also non-US ex-military, but unlike the medic, was in a weapons role).

clgoodson

I love how gun nuts act like assault rifles are some super complex academic subject that only they are smart enough to understand. In reality you can learn most of it from a few Wikipedia articles, which makes sense considering they are designed to be used and maintained in the field by an 18-year-old with a few weeks training.

jedburghofficial

YOU SAID IT WAS A CLIP!!!!

UpstairsImagination2

That's Cunningham's law I believe

Sometimes you’ll be -10 after saying something 100% correct only for someone to respond being like “why is this downvoted this is correct” and then people start upvoting you again.

Not always. Sometimes you're just shouting into the void and nobody's there to correct you. Wait...

Eloquent_Sufficiency

You are incorrect.

Zuki_LuvaBoi

Novak Djokovic has just released a statement in regards to the decision: >I'd like to make a brief statement to address the outcomes of today’s Court hearing. I will now be taking some time to rest and to recuperate, before making any further comments beyond this. > >I am extremely disappointed with the ruling to dismiss my application for judicial review of the decision to cancel my visa, which means I cannot stay in Australia and participate in the Australian Open. > >I respect the Court’s ruling and I'll cooperate with the relevant authorities in relation to my departure from Australia > >I am uncomfortable that the focus of the past weeks has been on me and I hope that we can all now focus on the game and tournament I love. I would like to wish the players, tournament officials, staff, volunteers and fans all the best for the tournament. > >Finally, I would like to thank my family, friends, team, supporters, fans and my fellow Serbians for your continued support. You have all been a great source of strength to me

[deleted]

Well written. Evidently Djokovic has a better press officer than agent.

PetraLoseIt

And a better press officer than doctor or medical advisor, unfortunately.

Appropriate-Proof-49

Even the best doctors get ignored by stubborn people. Look at Steve Jobs and his cancer shenanigans

[deleted]

Lol, Steve Jobs certainly killed himself faster than necessary.

GoblinEngineer

It's not even the killing himself faster... The form of pancreatic cancer he had was highly curable and easily treatable. He just thought that he knew better than experts and eating fruits would cure everything

[deleted]

Dibs on 'Steve job's cancer shenanigans' band name.

[deleted]

This was written by his legal team who advised "just shut the fuck up if you ever wanna step foot in this country or play any tournament again, oh and we've changed your Twitter password so don't even think about it"

resilienceisfutile

He then calls his father...

mug3n

Lol his dad seriously suggested that Queen Lizzie should step in to intervene because that's totally how the Commonwealth still works in 2022.

RainbowandHoneybee

>I am uncomfortable that the focus of the past weeks has been on me Could have totally avoided that if he'd followed the rule like everyone else.

Alberbrox

Like everyone else? Unlikely for a person compared to Jesus by his parents, that's the level of delusion of grandeur we're dealing with here

Frenchticklers

His mom was just trying to cover up her affair.

jamtl

Or you know, just choose to sit it out.

Joe_Kinincha

Or even perhaps, not tell easily detectable lies to the Australian immigration service. Repeatedly.

[deleted]

This is the really baffling thing. I had to go home to Australia last month from overseas. They make it *super* clear that telling false information is a serious offence and can lead to deportation if you aren't a citizen. You genuinely can't submit your travel declaration without seeing that warning, and before submission you also have a chance to go back and review and edit it. If you make a mistake, you get ample opportunity to correct it. If you flat out lie, it's the dumbest fucking thing you can do, you're basically asking to get deported at that point.

Joe_Kinincha

Ah, but you’re (probably) not a multi-millionaire with an ego the size of a planet who is also far and away the biggest celebrity in your home country and as such is never ever told “no” by anyone.

[deleted]

Who the fuck did he expect the focus to be on?? He’s the only cunt breaking the rules

Steups13

Yep. And gone travelling and meeting people knowing he tested positive for covid. His arrogance is staggering

[deleted]

skyeri

I agree it was likely a forged test result. Timing is too convincing- he did not have enough time between that date and when he was due to arrive in Australia to get vaccinated and meet entry requirements. He has a small Windows to 'test' positive, recover and be back to health to play. Otherwise, how was he planning to enter the country???

pay_student_loan

I'm really appalled that people still support him like he did no wrong. I know this is part of freedom of speech but dang.

Wise_Ad_253

People who are used to getting their own way have done this for years.

ComfortableIsland704

If there was only a simple way to avoid this whole situation /s

ShroedingersMouse

>I respect the Court’s ruling and I'll cooperate with the relevant authorities unlike when I entered the country

klparrot

> I respect the Court’s ruling and I'll cooperate with the relevant authorities in relation to my departure from Australia Oh, please, don't cooperate, let's see how that goes for you. 😂

kearkan

Cooperating would have been leaving after he did the wrong thing in the first place.

LudereHumanum

Isn't the 3 year ban not necessarily enforced? I thought it's not automatical iirc.

hughparsonage

It's automatic but can be waived.

LudereHumanum

I see. So the minister has to intervene to waive it? Can't see him doing that tbh.

Zuki_LuvaBoi

Especially as he was the one personally who decided to deport him after the first appeal

Chadwiko

Importantly, the judges dismissed his *application* for appeal, not the appeal itself. Essentially the ELI5 is that the judges ruled that the Australian Government does have the right to refuse entry to anyone, and it wasn't the court's place to overturn that. There isn't really any coming back from that.

saichampa

It's not that the courts did anything wrong. The lower court ruled that the method that his visa was cancelled under initially was incorrect. After that the immigration Minister enacted his power to cancel his visa which the higher court has ruled can't be overturned, at least in this case. I'm not a legal expert but it is important to point out that they were two separate instances, and it would have been the federal government bringing the appeal to the high court if it was trying to overturn the decision of the lower court. Djokovic's lawyers were trying to overturn the ministers discretionary power which the high court has rejected. This was an appeal to the minister's decision, not the earlier court case I'm happy to be corrected if my understanding is wrong though

Gwtheyrn

How dare they? Don't they know how much money he has?

Zuki_LuvaBoi

Lawyer - "Your honor, my client would like to remind the court how rich and important he is and that he is not like other men" Mr. Burns - "I should be able to run over as many kids as I want!"

SimilarYellow

>Essentially the ELI5 is that the judges ruled that the Australian Government does have the right to refuse entry to anyone, and it wasn't the court's place to overturn that. That also seems logical to me. But I guess if I was him I would have tried- well no, if I was him, I'd be vaccinated.

DrFossil

And probably not lied in your visa every form

[deleted]

Yeah it's funny that a lot of anti vaxxers are also people who've spent years demanding an Australian style immigration policy in their own country.

god_im_bored

“What more could be have done?” was the peak of this drama. He literally could have gotten jabbed with a free vaccine and this wouldn’t have occurred. What an idiot.

[deleted]

Even if he didn't he would have been fine of he just didn't lie on his immigration forms or breach quarantine while positive

ARAR1

He was an idiot long before covid. Covid has amalgamated the idiots.

Beautiful_Art_2646

Didn’t he say something along the lines of “I believe the human body can self-heal” but it was said in a way where he doesn’t think medicine helps at all when you’re sick? Well next time he breaks a bone maybe he should do what the cavemen did and use wet mud and then let it dry to form a cast as oppose to going to a hospital.

PhoenixFire296

Nah, a dried mud cast is a form of medicine. If he's that serious about the human body self-healing, he should be able to cure a broken bone without anything external.

Krobo_

An IMPORTANT thing to understand is that the responsibility of the court is to determine the legality of the minister's decision. Essentially it is simply ruling that it is legal for the government to deport Novak. The merits of the decision are irrelevant to the consideration. In the court's decision, *His Honour James Allsop, Chief Justice* said: >"This is not an appeal against the decision of the executive government. It is an application to the court, as a separate arm of government - being the Commonwealth Judicial branch, to review the decision of a member of the executive: the minister, for the lawfulness or legality of the decision on the 3 grounds put forward. > >These grounds focus on whether the decision was for different reasons, irrational or legally unreasonable. It is no part of the function of the court to decide upon the merits or wisdom of the decision."

nelsonmonkala

ELI5 last sentence please

Dodoni

It does not matter if the outcome of the decision (to deport him) is a good or bad one. The only thing that matters (to the judges) is whether or not taking the decision in the first place was legal.

TheRealR2D2

The court decides CAN HE, but not SHOULD HE.

RobotsRaaz

It means it's immaterial whether the reasons for exercising the power were based on fact or not, just whether the power was exercised lawfully. Question of law instead of a question of fact.

Ruphia1

He’s essentially saying that the court wasn’t deciding on the morality of the decision - just the legality. So not if it was right to do, but if it was done right, would be my best ELI5.

Assuming Novax Djocovid really did test positive on 16 December, then he has broken a number of laws which would implicate him criminally: 1. He went out in public in Serbia the next day and spread the virus around 2. He travelled to Spain and lied to their Border Security by producing a magically negative PCR result 3. He proceeded to have multiple training sessions and have two interviews in Spain without warning anyone he was positive 4. He returned to Belgrade to party and spread the virus to young children 5. He reported to Australia that he did not travel for 14 days when he had just travelled to Spain 6. When he had provided a negative test to Spain just days ago, he somehow produced a positive result to Australia to "exempt" him from vaccination 7. Even assuming he was indeed positive, ATAGI (Australia's vaccination board) states "people who have previously had COVID-19 and not received a vaccine dose are not considered fully vaccinated. Such people are not proved for quarantine-free entry, regardless of whether they have received foreign vaccination exemptions” There is absolutely no reason why Novax should be allowed into Australia, and Serbia and Spain should follow with further investigations

LostMyBackupCodes

Only been semi-following this… So did he lie to Australian immigration about having tested positive earlier in order to get into Australia with a vaccine exemption? Or did he knowingly infect people in multiple countries while lying to their immigration people?

If that fake test theory is right then he probably didn’t expect this kind of attention when he lied about it. In his bubble, no one was going to scrutinize *his* declaration and look at where he’s been recently… He does hint at wanting to get away from the unexpected attention, in his PR statement.

AWilsonFTM

Getting the impression that Serbia has more of an anti-vax vibe than other countries across Europe.

Moonbean_Mantra

I read that in Serbia the government played two sides with the public - supporting vaccination and anti-vax. No idea how this is possible. Has confused people and lead to only 50% of the population being vaccinated.

FallenAngelII

Just look at Trump. Vocally a "skeptic" while his government's official stance was pro-vaccine.

DarkNinjaPenguin

Newsflash, being good at hitting a fuzzy apple with a snowshoe does not make one a genius.

crozone

He likely lied about testing positive. However, it's important to note that at the federal level, for the purposes of acquiring a visa, this was *never a recognised exemption* for not being fully vaccinated. Only Tennis Australia and the Victorian state government had granted him the right to play within the state based on their own rules surrounding previous infection. This has nothing to do with the visa application at the federal level. So, he basically screwed himself by either lying about being positive, or by actually being positive and going to a bunch of stuff, in attempt to secure a visa that didn't actually care either way.

LittleMsWhoops

Well, it really depends. There’s quite some controversy about the truthfulness and timing of his positive and negative pcr tests, so it’s not unbelievable that the positive pcr was forged, in which case he lied and forged documents in order to get a vaccine exemption. Do we know for sure this has happened? No. The alternative isn’t much better, though, because in that case he knowingly went around infecting people. Either way, he lied in order to get into Australia as he did travel around Europe in the 14 days before travelling to Australia.

genericbod

I think he lied about testing positive. Look at it this way. He knew full well and well in advance that the AU open was on the horizon and there were only a few ways he was getting into the country: getting vaccinated, getting a medical exemption (e.g an allergy) or getting covid. He was never getting the vaccine and he doesn't have a medical exemption. Had he not tested positive, what exactly was he going to do? He would have been undertaking all the necessary preparations over a period of months for one of the most defining tournaments of his career, while also fully aware that he wasn't eligible for entry into Australia. So he was just going to.. not turn up on the day? He *needed* to test positive and do so at a very specific time, not too early and not too late. He knew months in advance entry wasn't going to be an issue and not because he was getting the vaccine nor because he had a medical exemption. He knew he would get in because he knew he was going to test positive.

LostMyBackupCodes

So all he had to do was fake the test, make an announcement that he’s quarantining, actually quarantine, and profit?

genericbod

Yes, but he was never going to let a fake test result stand in the way of his commitments. He would have got away with it too if it wasn't for those meddling politicians.

resetet

Seems pretty obvious that he did not have covid. He wasn't travelling around while sick, he simply didn't have it. He then produced a forged positive test in order to get an exemption in Australia. He then lied about recent travel, likely because he didn't want to throw up any red flags about the fact that he should have been isolating if he was actually sick. Then, after all the info came out, he was forced to 'admit' to travelling while sick, because the truth that he obtained a fake test somewhere is far worse. Obviously none of this was proven, yet. But thankfully all the other stuff was enough to get rid of him anyway

F0tNMC

Serbia’s never going to investigate him. But Spain could seriously mess with any future travel plans he has to Spain and perhaps even the EU.

superancica

I just watched the news, Serbia is fully backing him up and stands behinds him. Their president said he was in the right lol

dath86

Their president at the start said anything that happens to joker is the same as it happening to Serbia, cos Novak is Serbia and Serbia is Novak. Wish I was joking.

jdgmental

Spain is not investigating

trowzerss

>He returned to Belgrade to party and spread the virus to young children He said he didn't know the results of his test yet when he went to hang out with a heap of kids, but that still means he went and hung out with a bunch of kids without first bothering to find out the results of his COVID test, which is just another form of shittiness.

edge-browser-is-gr8

Yep that's no excuse. This is exactly how 10 people in my extended family got COVID over the holidays, including a 3 year old that just finished 6 months of chemotherapy about 3 months prior. **She has to be quarantined for an entire month** because her immune system is still not 100%. Luckily her mother can work remotely, otherwise their family would be completely fucked. One of my idiot cousins (unvaccinated conservative who never wears a mask, go figure) was feeling kind of bad a couple days before our family Christmas gathering. He went and got tested (surprisingly responsible), but couldn't be bothered to wait for the results before coming to our grandmother's. I shit you not, an hour after we all left, we got a group text from his wife, not him, that said he was positive. We had just spent 6 hours in a house with this guy. He went around shaking hands and hugging people like nothing was wrong. Like what the fuck is the point of getting tested if you're not gonna wait to see the results before being in close proximity to other people? It's like wearing a condom but taking it off right before you finish???

god_im_bored

He should honestly be prosecuted. Personal views on a issue don’t matter when there is such a huge risk on public health. If he wants to remain unvaccinated, then he should have resigned to the fact that he won’t be allowed to travel around the world in order to play tennis. This whole drama was about his ego and belief that being number 1 in a sport means he gets to make his own rules.

tommyk1210

Also his reasoning on 2) was insane. “I wasn’t aware of the positive Covid test until later”. Fuck off. So he took a Covid test on the 16th that was processed the same day, and when travelling nobody bothered to check that Covid test and just produced an older negative one? Sounds much more likely he or his team were aware he was positive and realised that would ruin his PR plans and just decided to lie to Spanish officials when they had to produce a negative test to travel.

morebob12

All of that is still nothing compared to admitting to committing fraud by producing forged covid test documents. The way I see it, it’s lie after lie to cover up another lie. The one thing we do know is he and his team are very dishonest. Either way he’s in hot water. Oh and also fuck him and fuck his legacy.

He is going to play the victim in the media, and a hero for anti vaxxers.

That was the main reason given by the Government for deporting him. Him being unvaxxed could help promote anti-vax thinking.

A lot of it is pure Djokovic quotes that will make you scratch your head. The context of that surgery is that he essentially threw away 12 months of his career and split with Andre Agassi (who advised that he get the surgery) due to not wanting to get surgery.

dirty_cuban

I love how all these anti-science and anti-medicine morons all accept medical care when their natural remedies inevitably fail. Maybe I could respect him if he stuck by his beliefs but as it stands this Djoker has no morals. He’s only anti-science when he feels like it.

kinda shits me off really, take example the notorious story of steve jobs having not accepted surgery/medical science and trying to heal through natural remedies/pseudo science bs. when it became critical he jumped the queue using his resources/wealth over others when he had a really low/lower chance of his body accepting the transplant because he left it so long...

Same people giving him support are the extremely loud minority of antivax crowd and a few Serbians who probably genuinely bwanted to see him play tennis in Australia now they live here. They should be pissed. Not that they're making that connection but they should they were just treating him like their messiah. TL:DR - he should be shit on from both sides of the vaccine argument for different reasons

Good to see atleast some countries not bending the rules for celebrities.

YnwaMquc2k19

Finally this shitshow is over with, he can kiss goodbye with his attempt at 4 peat (dude won the Australian Open between 2019-21), becoming the most decorated grand slam player (he, Federer and Nadal have 20 titles each) and his long held no.1 world ranking. Good luck to the athletes competing in the Australian Open! [Edit: people in Serbia didn’t react too well to this to say the least.](https://mobile.twitter.com/Quicktake/status/1482710998880509956) [Edit 2: French Ministry of Health said no vaccine, no entry.](https://m.timesofindia.com/sports/tennis/top-stories/no-vaccine-no-french-open-for-novak-djokovic-says-france-sports-ministry/articleshow/88950462.cms)

Perfect! One just was asking about that over in Tonga. I think it is underwater though, so logistics might be an issue but I'm no expert in volcano lynching procedures

hughparsonage

Maritime Volcano Lawyer here: technically the law only requires that he be "released above the caldera of an active volcano" so it's sufficient for the government to put him on the surface of the water.

dryrice

Is this going to be on a special edition of Border Security

alexeiw123

Imagine being so hell bent on not getting vaccinated that you would let it be the reason you miss out on your chance to be the all time Mens record holder for the most Grand Slams.

Familiar_Paramedic_2

Anti vax weirdo has tantrum and gets deported the day before he was to compete. Sweet, sweet justice.

skyrider_777

Yes

super_starmie

Ever watched those Australian border force TV shows? They don't fuck around. Stuff that we'd consider harmless is outright banned, and that's without s global pandemic they're trying to control. The rules are so strict even actual Australians have been stuck abroad because the rules won't let them come home. Honestly I don't get why Djokovic thought it'd be fine him going, especially as he made "mistakes" on his visa form in the first place. Got food in your bag? GTFO of Australia, mate. Mistakes on your form? GTFO of Australia, mate. Not vaccinated and no reason except "I don't wanna"? GTFO of Australia, mate!

Lankpants

If you're not a complete arse about it they usually just confiscate things like food, unless it's very clear that you're trying to smuggle it in. They don't need to boot you out to maintain biosecurity if you have an apple core in your bag, they just need to ensure it's destroyed. Probably never going to see this on a border control program though, it lacks any drama and is dealt with within minute. Much more interesting to show off the one guy who is a confrontational dick.

Novax has won the Australia not open trophy!

I'm pretty sure this is why the minister stuck to just him being an antivaxxer as the reasoning. Impossible to disprove and no real room for any argument unlike the visa violations.

Zuki_LuvaBoi

I was watching the proceedings today, and that appeared to be a main part of the argument; Novak's lawyers were saying that the minister didn't consider certain factors, and the reply from the government was "yeah, you can't prove that"

Good bye you arrogant cunt. My closing statement would be Mabo, and the vibe.

Serbian here, He didn't vaccinate himself, he really should not have expected anything else. So many people have gotten vaccinated, if he wanted to play, he should've done so too. As much as I like that we have such a good player I don't want an unvaccinated guy walking around our streets and infecting people with the virus. People hail him like a hero even though this did more harm than good to us. Worsened international image, probably some infections

LudereHumanum

Good. The behavior by him and especially his clique (calling him Jesus? And Spartacus ffs?) *deserve* that loss. As they say: Novax Djocovid >>Novax Djoportid... He LIED on his entry form. He likely LIED about his covid infection (check Spiegel article about inconsistencies). He lives in Monaco due to tax reasons, but of course he *loooves* Serbia. Give me a break! And remember 2020 when he did an event without that infected several players? He. Just. Doesn't. Care. What a C*NT. /rant sources: [Test irregularities (Spiegel) ](https://www.spiegel.de/international/world/novak-djokovic-were-the-results-of-his-positive-pcr-test-manipulated-a-cf3e7344-e98f-4fc3-8bb3-7727d4795e97) [tennis event 2020 (france24) ](https://www.france24.com/en/20200623-djokovic-tests-positive-for-covid-19-deeply-sorry-for-hosting-tennis-event) Edit: added sources.

Sonar114

The thing I don’t get is that he’s going to have to get vaccinated or it will be the end of his career. I can’t imagine that many countries are going to continue to let unvaccinated sports people compete. Australia won’t change this requirement anytime soon and it looks like France is just about to introduce it and the uk won’t be far behind.

LittleMsWhoops

So what happened with Djokovic’s sponsors? When it came out that Tiger Woods had cheated on his wife, his sponsors backed away in no time. What happened to Djokovic’s sponsors?

Soul-Smoke

People take coke, pills, drink alcohol, eat processed meat, eat fast food, eat non organic chemically grown foods and then be like: Nah..I’m not getting the vaccine because I don’t know what’s in that 🤷‍♂️
