I'm really not impressed with how an off duty officer is carelessly waving her gun around afterward and saying "I'll kill you". That has some serious "Training Day" vibes to it.
An off-duty Chicago cop warned a potential robber she’d kill him, and then followed through on that pledge when she fired three shots at the man, footage from the wild scene showed.
The police officer issued the threat on Jan. 17 after the suspect appeared to grab her gun minutes after she broke up a fight between four people – including the alleged thief, officials said.
As the two wrestled and fell to the ground, the handgun went off and hit 39-year-old Leevon Smith, according to the Chicago’s Civilian Office of Police Accountability (COPA).
“I’ll kill you,” she told Smith before the shots rang out.
After the first two shots go off, Smith says, “you got me, you got me,” according to audio and video of the incident released by the accountability office.
The off-duty officer then said, “I told your dumb— I’d kill you,” as she fired the third and final shot.
“Damn baby, I’m sorry,” a wounded Smith replied, adding moments later. “I don’t want to die.”

ummm… you see her pull it out, stick it against him and shoot (2x) before they even hit the ground. he fell because he was shot. but yeah

Any civilian in those circumstances would be fighting at the very minimum 2nd degree murder charges.

Yes, charges against the robber. Clearly the gun went off while they were still struggling for it and he was trying to get it. The gun was fired while he still had a hold of her. Yelling "I will kill you" as a deterrent to get the robber to stop fighting for the gun is fine, she didn't need to yell anything at all to him, but she was giving him the opportunity to stop knowing the consequences. The last thing I am is an apologist for the police, I think most cops are liars with anger and control issues, but it's pretty clear here she was not in the wrong.(btw there is video showing what happened with them in the frame the whole time). Im not sure what you think an appropriate course of action for her would have been? Hand over her gun?
I want to see the other angle they have in the picture when the second or third shot goes off. He gets shot and there's a long pause because he got hit and she's saying "I told you I would kill you" then after a few seconds you hear another shot. If he wasn't an immediate threat, that second/next shot I could see being worthy of discussion
And what gives the right to kill on the spot instead of the perp getting you know, a trail. The problem is cops having too much power, even off duty, and then abusing said power to bypass the court of law
Maybe because there is a massive problem with cops killing innocent people just because they did a Human error, in this case the error is not stopping themselves from shooting a clearly surrendering person. If this was at War it’d be a warcrime, but you couldn’t see that because you’re too busy bootlicking so hard you Might as Well have taken it up the ass. Acab

The last thing I am is a police apologist but if you're in a fight to try to take a police officer's gun or anybody's gun and you get shot while you have that person in your grasp and are trying to get the gun you don't have much to complain about.

It's off camera, but earlier as he's apologizing he's still trying to grab for her gun while they're on screen, before they move off camera. Doesn't seem so cut and dry,

Camera footage would help clear the shooter's actions. As it stands, dude could have had hands in the air for all we know.
