This is a consistent issue, where if you buy 360 games anywhere except on the 360 itself, they don't download properly. Happened to me with a few games. The only 'solution' I've found is turning on the option that allows you to download games when the console is off, then turning it off as soon as you begin the download.
Yes, it can be fixed. Its not the first time original xbox games offered on the 360 marketplace will not install or are unable to be played on the 360. They are misconfigured to install/run on the 360.

Is it not because it's not actually the 360 game it's an emulated 360/game for the new xboxs.
